Tribal Wars is an upcoming total conversion modification for Enemy Territory: QUAKE Wars that promises to bring a Cyclops-sized dose of Starsiege: Tribes to the game. The mod is said to focus heavily on CTF-style gameplay and will feature all-new weapons, player models, and levels. For those of you wanting to see and read more about it, the Tribal Wars website is now online and features a trailer, screenshots, concept art, and a development blog. There’s no release date yet, but the team is looking to have a public beta at some point in the unspecified future.

Also, is it a problem they refer to the “original game”? Don’t want to see this mod end with a cease-and-desist letter posted on their website…

I have no idea how trademarks and pattens work exactly, however for as far as I know:

  • Gameplay can not really be patented, unless something is really a carbon copy of another mod.
  • Tribal Wars does not seem to refer to Tribes except in the description of the project, as long as they don’t put references to Tribes in their mod they should be fine
  • Artwork (including maps) is always owned by the original author (or company he or she works for), which means you can not replicate / copy them without approval

I used to play Star Trek Voyager Elite Force, and a group of developers started working on a stand alone RPG game. As far as I know they never had any issues, as long as they didn’t feature any real Star Trek characters, ship names or put Star Trek in the title of their game.

What I am concerned about is referring to Starship: Tribes and Unreal Tournament on their website without applying trademark signs nor putting a disclaimer on the bottom of their page stating the trademarks are owned by Sierra and Epic Games and that the team behind Tribal Wars is not involved in either of these two companies. I guess pointing that out wouldn’t do any harm.
