In terms of a suit, where are the damages to ET owners?
1)the game is given away for free
2)the mod makers charge nothing for it
Hmmm. No harm no foul seems to come into play. Where are the civil/monetary damages?
The other alternative is jail/criminal penalties. Activision and a judge/jury are going to throw someone in jail for modifying a map in a free game? Life penalty!
Also, I have not read the EULA, nobody reads the EULA, those eulas could say I owe them 1000 million dollars in there I an would click yes I accept fully all the above terms. Hmmmm. so really a software company would just have to put out a product, get like 1000 people to use it, make the eula state I will pay say 2000 dollars, and BOOM he sues becomes a millionare. Heh. Right… whoever believes that should try it. If my real estate agent slips in all those forms I sign when I buy my house that I will give him the house for free 10 years from now is that gonna be upheld? Or is the agent gonna be stripped of his liscense for trying that? I dont even recollect clicking yes to a eula in ET installation, and I just redid it recently. Oh well, I guess I will send activision my first born child for playing thier free ET game : ) heh, what I will almost certainly do is pay them for thier upcoming RTCW2 game since they have me hooked on the free ET. I think I should sue them for monetary damages of lost time… Giving away a dangerous addictive substance like ET, its like free samples of crack, with rtcw2 being the kicker you cant help but pay for.
