Understanding the EULA for the mod source code.

(Seph64) #1

Ive read the distribution part of the mod source License agreement, and have a question.

Is it legal to distribute my modification of the mod source in the form of source code? As in, can I release the source code for my sephmod modification (for free and across the net obviously) on the net? Or is that prohibited by the EULA?

Thanks in adivance.

i dunno , but it should be legal
as you are posting it with no anti protection hacks , and etc …
also there was already released one changed sourcecode…
But officially I dunno…

From my non-lawyer reading, it looks like it should be OK, assuming you abide by the other restrictions (export controls, not for profit, etc)

, ID grants to you the non-exclusive and limited right to distribute copies of the Software free of charge for non-commercial purposes by electronic means only and the non-exclusive and limited right to use the Software to create your own modifications (the “New Creations) for operation only with the full version of the software game WOLFENSTEIN™: ENEMY TERRITORY™; provided, however, you shall not make any New Creations unless and until you have agreed to be bound by the terms of this Agreement and of the LIMITED USE SOFTWARE LICENSE AGREEMENT which accompanies the full version of WOLFENSTEIN™: ENEMY TERRITORY™.

Certainly that seems to be the intention, and previous quake3 and et mods have distributed their source without getting into legal trouble. Attempting to re-license or claim ownership to the original code would be another matter.

Actually, if you read the License.rtf literally, it says you can’t even make any modifications to the source code

This post by RR2DO2 says implies that it’s OK to release source for a mod under the OSML though:

So if Activision lawyers come knocking, blame him.
