As we are getting closer and closer to finishing our project, suddenly a question popped up to our head about the swastika on the plane FW 190A. We did some searching and asked some people around who might know if it is illegal in Germany and France, but with no clear answer.
We ask this because German servers might not allow this if it is illegal.
Can anybody help us out with this question? 
Well in our clan there are a few creative minds and one member has made some wallpapers with svastika’s.
Now, I said it was illegal for German’s to even watch it ^^

Hmm, I registered and had a look. From what i understand any kind of Swastika is forbidden except for historical issues. 
Damn, these crosses just make the plane feel so much nicer, what a waste.
I just hope one day people can understand that it’s history and it happened and we cant deny it.
Yes, i remember it. But i hoped it is different with this, since this is on the planes and on wikipedia i noticed nothing about it or i just misread.
nice plane. btw i see no swastikas on it so its not illegal, i se the balkenkreuz on it, witch is legal and im not sure but i think its used right now
Well, only thing I could find is that Germany has a prohibition on the use of swastikas. This could give problems when being put on German based servers, indeed. On the other hand, you could give a twist to the argument that your swastika is being used for historical purposes, as games such as RTCW and W:ET do carry an amount of historical weight. If you argue that your swastika is a part of depicting historic scenes or such more, perhaps it might be considered legit.
As for other servers, based in other countries, there seems to be no problem. Some time ago, Germany lobbied for a general prohibition on the use of swastikas in the European Union, but the idea was countered by the Hindu community for whom the symbol is actually a deeply religious one.
Lastly, I will add that the symbols you use on your aircraft, in my opinion, doesn’t symbolize the real swastika, rather some other military symbol especially used to mark the German aircraft at that time.
there is a special version of RTCW for germans, where the swastikas are replaced with the wolfenstein logo. and ET is also censored.
Best way to deal with this in my opinion is to create 2 separate pk3 files:
One pk3 file containing your map,shaders and all other assets, without any nazi symbols.
Create another pk3 file containing only shaders and textures with nazi symbols. Put these 2 pk3’s into a single zip file together with a readme file.
This way server admin can decide if they want to host the map with or without nazi symbols.
As Tyrlop stated - there are no any swasticas and those black crosses are allowed - becouse present German army use almost same cross as their logo. See: Bundeswehr@Wiki
I would suggest a reversed FireFly’s method. Create your map with a plane with swastika, and with it release another pk3 with swastika fix, so those server admins who wont like it (or theyr server hosting dissallows it (yesterday I read some hosting’s policy)) can add that pk3 (and I suggest make it optional)
It sounds like some ppl got little confused, it’s not actually about swastika, it’s about that cross on the plane. So it’s not a swastika, it’s a cross unknown. Cheers!

But the Luftwaffe cross should not be illegal obviously?
If they are, then probably the only way like suggsested is to make 2 pk3 of the map. One with the Crosses and one without.
I just looked it up: The cross on the plane is legal, so don’t worry about it

Well since it’s a balkenkreuz (thanks for that, Tyrlop ^^), I don’t think that is illegal and can be used on any server (German or non-German)

The SS-Deathhead and the “Gaudreieck” are banned too, but not in the list.
Banned are also - as far as I know - images of Adolf Hitler and Heinrich Himmler.

Nazi symbols are only allowed for teaching, history related and art.
Computer games are not considered as art here in Germany.
I think it’s illegal to possess them.
So not only server owners would do something illegal.
All the german users that would download the files would do something illegal.
You should try to avoid these symbols.
And use those of RTCW / W:ET instead.
In RTCW there are also planes.
Not sure if they have a symbol.
If its only about that black cross, then its totaly legal. Remember IL2 sturmovik
