Legal of not?

Hi everybody,

Since I started to learn how to make soundpacks it’s been a real blast for me cause I always worked with sounds etc when I still made music.

But now I wonder if it is illegal what do?

I just take the voices out of games like duke nukem and implant them in the ET quickchat menu.

I don’ think it’s legal, but the games are so old, I don’t think anybody will care.

Unless the sounds are public domain I think it is illegal.

(P4nth3r) #3

If the source of the game is open, is it legal then??

(Chruker) #4

No. You need to check the license that came with the software. And it would need to state that you can use the media for other uses.

(fretn) #5

its not legal, 3d reals didnt allow things like this two years ago, and I doubt they will allow it now

duke nukem 3d deathmatch <3

who cares? do something new, mainly because DN3D is somewhat mess…

i made a soundpack with sounds from the original wolfenstein 3D and boy was that fun and an old game too. im sure even if it is illegal they probly wont give a care its not like they are makin money off that game anymore

(P4nth3r) #8

Ok, so it’s not legal, does any of you care about this??
Or has anybody ever had a lawsuit for ripping sounds/graphics from other games/movies??

Before SD was founded, and a few of us were working on the Q3F mod for Quake 3, Valve asked us to change the name of both the mod itself, and various elements so that it didn’t infringe on one of their intellectual properties.

There are also quite a few mods that were ‘foxed’ (as in ‘shut down by Twentieth Century Fox’ :)) because they infringed on movie licenses, such as AlienQuake.

So, it does happen. Would it happen to you, as one person releasing a sound-pack from an old game? I doubt it, personally, but it doesn’t change what it is.

(P4nth3r) #10

Hmmmm, Well I did make a “Predator” soundpack (predator is owned by fox)
But I haven’t heared anything about it.
But how about the star wars mod?? George Lucas doesn’t like that kinda stuff either I think.
Anywayz, I don’t care about lawsuits (let them find me first)
I just make things that I think are fun.

Btw. I’m working on a fully legal soundpack now (with my own voices and voices from some clan members)
But that is so much more work then just ripping some voices. :stuck_out_tongue:

i doubt fox ever discovered about you sound pack… i have never seen it on a server anyway… if they do its a bit l8 now anyway

You have all seen the ETQW trailer. At the end, there is a human in a vehicle and an evil alien that attacks him with a spike. Rumour say that the human is a modder working on a soundpak, and the alien is a Big Corporate Lawyer.
On the other hand, lawyers move around in groups, so it might be a false rumour.

(Chruker) #13

What trailer? where?

(P4nth3r) #14

Well, my soundpack is on rtcwfiles.com and also on my clans ET server.
But it’s not really that big yet (doubt it ever will be)

But if they find out about it it will be so wide spread over the web that they can never stop it anywayz. =D

I think everybody will make what seems fun to him, legal or not.
ET would be much less fun if they wouldn’t.

uhhh right

(P4nth3r) #17

Anywayz, other question, how many maps/mods are out there that haven’t got something illegal in them??
Like:

Textures from other games/mods
Sounds from music, movies and other games?

(fretn) #18

its not because others jump into a deep hole, you have to

(Calzonzin) #19

It’s not a question of legality, it’s a question of copyrights. You may not be thrown in jail, but you may be sued for damages. How much? That depends on how good your lawyer is :). As others have said, measure your risks, read up about copyrights, and proceed with caution. No one here is a lawyer, so take what you hear wth a grain of salt.

There is a lot of history of companies suing modders for using their intellectual property (IP) as there is a lot of history of other companies not only allowing, but encouraging modders to use their IP. It’s definitely not back and white.

(Jaquboss) #20

That is because ppl who play it dont complain…
and if u use CoD texture/ sound , do you think that anyone from Infinity Ward wil everl play with it ?
