DIRTY BOMB “EPIC KILLS III 2016” CONTEST
OFFICIAL RULES
NO PURCHASE REQUIRED TO ENTER OR WIN.

  1.   Sponsor: The Dirty Bomb “Epic Kills III 2016” Contest (the “Promotion”) is sponsored by Nexon America Inc., 222 N. Sepulveda Blvd., Suite 200, El Segundo, CA 90245 (“Sponsor”).

  2.   Eligibility: The Promotion is open only to current players of Dirty Bomb who: (a) are at least thirteen (13) years of age as of the start of the Promotion Period (defined below); (b) are residents of the United States, Canada (excluding Quebec), United Kingdom, Germany, or France; and (c) have never been banned or suspended, or had an account banned or suspended, for hacking or similar violations of Dirty Bomb’s license agreements and/or Sponsor’s terms of service.  Any entrant that is under the age of majority in his/her jurisdiction of residence must have their parent or legal guardian’s permission to participate in the Promotion, and must provide evidence of such permission to Sponsor in whatever form required if requested by Sponsor.  Employees, officers and directors of Nexon America Inc., its affiliated companies, agents thereof, the immediate family of any such person (defined as parents, children, siblings and husband or wife), or those with whom such person(s) are domiciled, are not eligible to participate.  The Promotion is void where prohibited.

  3.   Agreement to Official Rules: Participation in the Promotion constitutes the participant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding.  Winning a prize is contingent upon fulfilling all requirements set forth herein.

  4.   Timing: The Promotion begins at the time the Promotion is announced on the Sponsor’s forum thread dedicated to the Promotion (the “Thread”) and ends on November 3, 2016 at 11:59:59 pm Pacific Time (the “Promotion Period”).  Submissions that are submitted before or after the Promotion Period will be disqualified.  Sponsor’s computer will be the official timekeeping device for this Promotion.  Entrants are responsible for calculating the difference in time zones.

  5.   How to Participate: To participate in the Promotion, entrants should create a video showing their “epic kills” in Dirty Bomb.  Once created, the video should be uploaded to YouTube and a link to the video’s location on YouTube should be posted to the Thread along with the entrant’s in-game name.

  6.   Submission Requirements: All videos submitted to Sponsor as part of the Promotion must comply with the following Technical and Content Guidelines.  Any video that violates these guidelines will not be eligible to be judged or awarded a prize:

Technical Guidelines. The video must:
a. Be in a format capable of acceptance by YouTube;
b. Be uploaded to YouTube;
c. Be between one (1) and seven (7) minutes in length; and
d. Be publicly accessible.

Content Guidelines. The video must:
a. Be of the entrant playing Dirty Bomb;
b. Contain footage created no earlier than October 10, 2016. The inclusion of any gameplay footage from prior to October 10, 2016 may result in disqualification of the video;
c. Not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright or trademark infringement;
d. Not in any way disparage Sponsor, any of its products or services, the Promotion, or any person or party affiliated with the Promotion, or alternatively appear to promote any direct competitor of Sponsor;
e. Not contain text or imagery that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous (as determined by Sponsor in its sole discretion);
f. Not include threats (expressed or implied) to any person, place, business or group;
g. Not violate the privacy rights or any other rights of any person, business or group;
h. Not name or depict any real life third party without his/her permission;
i. Not contain text or imagery that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
j. Not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the video is created.

Limit one (1) video per person or Steam account. Sponsor is not responsible for lost, late, incomplete, invalid, illegible or misdirected videos, which will be disqualified/not counted (as applicable), or for any error, whether human, technical or otherwise. Sponsor reserves the right in its sole discretion to disqualify any entrant it finds to be tampering with the operation of the Promotion, such as using automated submission or text generation software, or to be acting in violation of these Official Rules. In the event of a dispute as to the identity of an entrant, the authorized account holder of Nexon.net ID account that is used to register for the Forum will be deemed to be the entrant. The “authorized account holder” is the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address that registered for the Steam ID.

  1.   Intellectual Property: By submitting a video as part of this Promotion, each entrant acknowledges and agrees to the following:

a. Entrant irrevocably grants to the Sponsor, its agents, licensees, and assigns the unconditional and perpetual (non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use the video or any part thereof as-is or edited (with or without using any entrant’s name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from any entrant or any other party.
b. Entrant forever waives any rights of copyrights, trademark rights, privacy rights and any other legal or moral rights that may preclude the Sponsor’s use of the video, or require any entrant’s permission for the Sponsor to use the video.
c. Entrant agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Sponsor on the grounds that use of the video, or any derivative works thereof, infringes any rights that any entrant or third party may have as creator (or co-creator) of the video including, without limitation, copyrights, trademark rights, and moral rights.
d. Entrant irrevocably grants to Sponsor, its agents, licensees, and assigns an unconditional, worldwide, royalty-free and perpetual (non-exclusive) right and permission to use the entrant’s name, image, voice, and other likenesses that are included in the video or which are shared with Sponsor as part of entrant’s participation in the Promotion, in any media now known or later invented for any commercial purpose, including without limitation advertising or marketing of Sponsor’s products and services, without further compensation or the right to approve such uses.

  1.   Winner Selection: After the Promotion Period has ended, Sponsor will select a qualified judge or panel of qualified judges to judge all eligible videos according to the following criteria:

a. Creativity of kills – 25%
b. Video quality – 25%
c. Dirty Bomb skill/expertise exhibited in video – 50%

The judge(s) will select three (3) potential prize winners from among all eligible entrants using the judging criteria noted above. The potential winners will be notified after the date of selection at his/her email address listed in the entrant’s Steam account (or other means of communication as Sponsor may select). The potential prize winners may be asked to submit additional personal information in order to confirm eligibility and award the prize. Potential prize winners may also be asked to sign an Affidavit of Eligibility or Declaration of Compliance (as may be applicable given the location of the potential prize winner) unless this is prohibited by law. If the potential winners cannot be contacted, fails to respond to the notification within the required time period (if applicable), or fails to sign and return the Affidavit or Declaration within the required time period (if applicable), he/she will be disqualified and will forfeit the prize. If a potential winner is disqualified for any reason, Sponsor will award the prize to an alternate potential winner to be chosen based upon the winner selection criteria described in this Section.

Once confirmed in accordance with these rules, the prize winner with the highest judges score will receive the first place prize, the prize winner with the second highest judges score will receive the second place prize, and the prize winner with the third highest judges score will receive the third place prize.

  1.  Prizes:

First Place: Custom Dirty Bomb Branded Logitech G Daedalus Apex G303 Performance Mouse (approximate retail value: $100.00) + 100,000 credits + 2x Elite Cases

Second Place: 100,000 credits + 2x Elite Cases

Third Place: 65,000 credits + 2x Elite Cases

For all prizes: Any aspect of the prizes not described above (e.g., size, style, color, etc.) will be determined by Sponsor in its sole discretion. No cash or other substitution is allowed except by the Sponsor who may substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value, as determined by the Sponsor in its sole discretion. A prize (or part thereof) is not transferable or refundable and must be accepted as awarded. The winners are responsible for any and all other costs and expenses not listed above. Winners will be responsible for payment and reporting of all applicable taxes associated with the receipt and usage of a prize. Sponsor may report the receipt of any prize to the appropriate federal, state, or local taxing agency(ies). Please allow up to eight (8) weeks from completion of the Promotion for prizes to be shipped.

  1. Warranties and Representations: By submitting a video, each entrant warrants and represents that:
    a. the video is original to the entrant;
    b. the video does not infringe the intellectual property, privacy, publicity, or any other rights of any third party;
    c. the video does not violate any law, regulation, or any provision of these Official Rules;
    d. the video has not previously been entered in any other contest or promotion;
    e. the video has not been previously published in any medium;
    f. the entrant has read and understood these Official Rules;
    g. at all times the entrant have complied fully with these Official Rules; and,
    h. the entrant will continue to comply in full with these Official Rules until the Promotion has been completed.

  1. Privacy and Publicity: Except as set forth herein, all information submitted by entrants in the Promotion will be treated according to the Sponsor’s Privacy Policy (http://www.nexon.net/legal/privacy-policy/). Except where prohibited, participation in the Promotion constitutes entrant’s consent to the Sponsor’s use of his/her name, likeness, voice, opinions, biographical information, and country and state or province of residence for promotional purposes in any media without further payment or consideration.

  2. Indemnification: By entering, entrants agree to defend, indemnify and otherwise hold Sponsor, its parent and affiliated companies, and the agents, officers, directors, and employees of each (collectively the “Released Parties”) harmless from and against any and all liability of any nature whatsoever arising out of or relating to:

a. any technical errors that may prevent entrants from participating in any way;
b. unauthorized human intervention in the Promotion;
c. errors in the administration of the Promotion; and,
d. injury, death or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use of any prize, including any such claim by the Released Parties’ employees or any third parties.

Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages.

  1. Disputes: Except where prohibited, all entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Los Angeles County, California, United States of America. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California, United States of America, without giving effect to any choice of law or conflict of law rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.

  2. General Conditions: In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules or (b) award the prizes from among the submissions received up to the time of the impairment. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. The Promotion is void where prohibited.

  3. Winners List: The winners will be announced by Sponsor on the Thread page no later than thirty (30) days after all winners have been confirmed.

OFFIZIELLE GEWINNSPIELREGELN
Für die Teilnahme oder einen Gewinn ist kein Kauf erforderlich

  1.   Auftraggeber: Das Dirty Bomb-Gewinnspiel „Epic Kills III 2016“ (das „Gewinnspiel“) wird von Nexon America Inc., 222 N. Sepulveda Blvd., Suite 200, El Segundo, CA 90245, USA („Auftraggeber“) in Auftrag gegeben.

  2.   Teilnahmeberechtigung: An dem Gewinnspiel können ausschließlich aktuelle Spieler von Dirty Bomb teilnehmen, die folgende Voraussetzungen erfüllen: (a) sie haben das dreizehnte (13.) Lebensjahr zu Beginn des Gewinnspielzeitraums (siehe nachfolgende Definition) vollendet; (b) sind Einwohner der USA, Kanadas (ausgenommen Quebec), des Vereinigten Königreichs, Deutschlands oder Frankreichs und (c) wurden selbst bzw. ihr Account wurde noch nie wegen Hacking oder ähnlichen Verstößen gegen die Lizenzvereinbarungen von Dirty Bomb und/oder die Servicebedingungen des Auftraggebers vorübergehend oder dauerhaft suspendiert. Teilnehmer, die an ihrem Wohnsitz minderjährig sind, benötigen die Erlaubnis ihrer Erziehungsberechtigten, um am Gewinnspiel teilzunehmen, und müssen dem Auftraggeber auf Anfrage einen dahingehenden Nachweis in der gewünschten Form erbringen. Mitarbeiter, Funktionäre und Vorstände der Nexon America Inc., ihrer verbundenen Unternehmen und deren Bevollmächtigte, die unmittelbaren Angehörigen dieser Personen (d. h. Eltern, Kinder, Geschwister und Ehegatten) oder Personen, die mit ihnen im selben Haushalt leben, sind von der Teilnahme ausgeschlossen. Das Gewinnspiel ist dort ungültig, wo es nicht zugelassen ist.

  3.   Verpflichtung zu den offiziellen Gewinnspielregeln: Mit ihrer Teilnahme am Gewinnspiel gehen die Teilnehmer die volle und uneingeschränkte Verpflichtung ein, diese offiziellen Regeln und die Entscheidungen des Auftraggebers, die endgültig und verbindlich sind, zu befolgen und anzuerkennen. Der Gewinn eines Preises hängt von der Erfüllung aller hier genannten Voraussetzungen ab.

  4.                           Zeitliche Abfolge: Das Gewinnspiel beginnt in dem Moment, in dem das Gewinnspiel im Forum-Thread des Auftraggebers, der dem Gewinnspiel gewidmet ist (der „Thread“), bekannt gegeben wird, und endet am 3. November 2016 um 23.59.59 Uhr Pazifikzeit (MEZ -9) (der „Gewinnspielzeitraum“). Einsendungen, die vor oder nach dem Gewinnspielzeitraum eingereicht werden, werden disqualifiziert. Der Computer des Auftraggebers ist das offizielle Zeitmessgerät für dieses Gewinnspiel. Die Teilnehmer sind für die Berechnung der unterschiedlichen Zeitzonen selbst verantwortlich.

  5.   Teilnahme: Zur Teilnahme an dem Gewinnspiel müssen die Teilnehmer ein Video aufnehmen, in dem ihre „Epic Kills“ in Dirty Bomb gezeigt werden. Dieses Video muss dann auf YouTube hochgeladen und ein Link zu dem Video in YouTube muss zusammen mit dem im Spiel verwendeten Namen des Teilnehmers im Thread gepostet werden.

  6.   Regeln für die Einreichung: Alle an den Auftraggeber im Rahmen des Gewinnspiels eingereichten Videos müssen den folgenden technischen und inhaltlichen Richtlinien entsprechen. Videos, die nicht im Einklang mit diesen Richtlinien stehen, werden von der Beurteilung oder Preisvergabe ausgeschlossen:

Technische Richtlinien. Das Video:
a. Muss ein von YouTube akzeptiertes Format haben;
b. Muss auf YouTube hochgeladen werden;
c. Muss eine Länge von einer (1) bis sieben (7) Minuten haben und
d. Muss für die Öffentlichkeit zugänglich sein.

Inhaltliche Richtlinien. Das Video:
a. Muss von dem Dirty Bomb spielenden Teilnehmer stammen;
b. Darf keinen vor dem 10. Oktober 2016 aufgenommenen Inhalt enthalten. Wenn vor dem 10. Oktober 2016 aufgezeichnete Spiele im Video enthalten sind, kann das Video disqualifiziert werden;
c. Darf kein Material enthalten, das gegen die Rechte anderer verstößt oder irgendwelche Rechte verletzt, einschließlich und ohne Eingrenzung Persönlichkeitsrechte, öffentliche oder geistige Eigentumsrechte oder Urheber- oder Markenschutzrechte;
d. Darf den Auftraggeber oder dessen Produkte oder Dienstleistungen, das Gewinnspiel oder mit dem Gewinnspiel verbundene Personen oder Parteien nicht herabwürdigen und darf nicht den Anschein der Förderung eines direkten Wettbewerbers des Auftraggebers vermitteln;
e. Darf keine Text- oder Bilddarstellungen enthalten, die unangemessen, anstößig, obszön, gehässig, deliktisch, verleumderisch, herabsetzend oder beleidigend sind (die Entscheidung darüber liegt im alleinigen Ermessen des Auftraggebers);
f. Darf keine Drohungen (weder ausdrückliche noch stillschweigende) gegenüber Personen, Orten, Geschäften oder Gruppen enthalten;
g. Darf keine Persönlichkeitsrechte oder andere Rechte von Personen, Geschäften oder Gruppen verletzen;
h. Darf keine tatsächliche Drittpartei ohne deren Genehmigung nennen oder darstellen;
i. Darf keine Texte oder Aufnahmen enthalten, die Fanatismus, Rassismus, Hass oder Schädigung einer Gruppe oder einer Person fördern oder eine Förderung von Diskriminierung aufgrund von Ethnie, Geschlecht, Religion, Nationalität, Behinderung, sexueller Ausrichtung oder Alter darstellen; und
j. Darf kein Material enthalten, das gesetzwidrig ist oder in dem Rechtsgebiet, in dem das Video erstellt wurde, gegen Gesetze oder Bestimmungen verstößt bzw. diese verletzt.

Pro Person bzw. pro Steam-Konto darf nur ein (1) Video eingereicht werden. Der Auftraggeber haftet weder für verlorengegangene, verspätete, unvollständige, ungültige, unleserliche oder fehlgeleitete Videos, die (je nachdem) disqualifiziert / nicht gezählt werden, noch für menschliches, technisches oder anderweitiges Versagen. Der Auftraggeber behält sich das Recht vor, im alleinigen Ermessen Teilnehmer zu disqualifizieren, die seiner Ansicht nach den Ablauf des Gewinnspiels stören, z. B. durch automatisierte Einsendung oder Textgenerierungssoftware, oder die gegen diese offiziellen Gewinnspielregeln verstoßen. Bei Streitfragen bezüglich der Identität eines Teilnehmers wird der berechtigte Kontoinhaber des Nexon.net-ID-Kontos, das zum Registrieren im Forum verwendet wurde, als Teilnehmer anerkannt. Der „berechtigte Kontoinhaber“ ist die natürliche Person, der von einem Internetdienstanbieter, Online-Serviceanbieter oder einer für die Zuweisung von E-Mail-Adressen für die jeweilige Domäne zuständigen Organisation eine E-Mail-Adresse zugewiesen wurde, die mit der Registrierung für die Steam-ID verbunden ist.

  1.   Geistiges Eigentum: Mit der Einsendung eines Videos im Rahmen dieses Gewinnspiels bestätigt jeder Teilnehmer die Annahme folgender Verpflichtungen:

a. Jeder Teilnehmer gewährt dem Auftraggeber, seinen Bevollmächtigten, Lizenznehmern und Abtretungsnachfolgern unwiderruflich ein uneingeschränktes und unbefristetes (nicht exklusives) Recht und die Erlaubnis zum urheberrechtlichen Schützen, Reproduzieren, Kodieren, Speichern, Kopieren, Übermitteln, Veröffentlichen, Posten, Senden, Zeigen, öffentlichen Aufführen, Adaptieren, Modifizieren, Erstellen abgeleiteter Werke, Ausstellen und anderweitigen Gebrauch des gesamten oder auszugsweisen Videos (mit oder ohne Angabe des Namens des Teilnehmers) in jeglichen Medien weltweit für beliebige Zwecke, ohne Einschränkung und ohne zusätzliche Überprüfung, Vergütung oder Genehmigung eines Teilnehmers oder einer Drittpartei.
b. Der Teilnehmer verzichtet für alle Zeiten auf alle Urheberrechte, Markenrechte, Persönlichkeitsrechte und sonstige gesetzliche oder Urheberpersönlichkeitsrechte, die den Auftraggeber daran hindern würden, das Video zu verwenden, oder die die Erlaubnis des Teilnehmers für den Gebrauch des Videos durch den Auftraggeber vorschreiben würden.
c. Der Teilnehmer willigt ein, keine Verfahren, Ansprüche oder Klagen gegen den Auftraggeber mit der Begründung einzuleiten, zu unterstützen, zu führen oder zu genehmigen, dass ein Gebrauch des Videos oder daraus abgeleiteter Werke Rechte des Teilnehmers oder einer Drittpartei als Erzeuger (oder Miterzeuger) des Videos an diesen Aufnahmen verletzt, einschließlich und ohne Einschränkung Urheberrechte, Markenrechte und Urheberpersönlichkeitsrechte.
d. Der Teilnehmer gewährt dem Auftraggeber, seinen Bevollmächtigten, Lizenznehmern und Abtretungsnachfolgern unwiderruflich ein uneingeschränktes, weltweites, gebührenfreies und fortwährendes (nicht exklusives) Recht und die Erlaubnis zur Verwendung von Namen, Bild, Stimme und anderen Abbildungen des Teilnehmers, die im Video enthalten sind oder im Rahmen der Teilnahme am Gewinnspiel durch den Teilnehmer mit dem Auftraggeber geteilt werden, in allen jetzt bekannten oder später erfundenen Medien zu kommerziellen Zwecken, insbesondere Werbung oder Vermarktung der Produkte und Dienstleistungen des Auftraggebers, ohne dass hierfür eine Vergütung anfällt oder das Recht zur Genehmigung dieser Verwendung entsteht.

  1.   Auswahl der Gewinner: Nach Ablauf des Gewinnspielzeitraums wird der Auftraggeber einen qualifizierten Schiedsrichter oder ein Beurteilungsgremium ernennen, der/das alle qualifizierten Videos gemäß folgender Kriterien beurteilen wird:

a. Kreativität der Kills – 25 %
b. Videoqualität – 25 %
c. Im Video gezeigtes Geschick/Können im Dirty Bomb-Spiel – 50 %

Der oder die Schiedsrichter werden aus allen qualifizierten Teilnehmern unter Anwendung der oben aufgeführten Kriterien drei (3) potenzielle Gewinner auswählen. Die potenziellen Gewinner werden nach dem Auswahldatum über ihre im Steam-Konto genannte E-Mail-Adresse (oder auf einem anderen Kommunikationsweg nach Wahl des Auftraggebers) verständigt. Mögliche Gewinner werden eventuell gebeten, weitere Angaben zu ihrer Person zu machen, damit die Gewinnberechtigung bestätigt und der Preis überreicht werden kann. Die möglichen Gewinner werden eventuell auch um Unterzeichnung einer eidesstattlichen Erklärung zur Teilnahmeberechtigung oder zu einer Compliance-Bestätigung (je nach Wohnsitz des möglichen Gewinners) gebeten, es sei denn, dies ist gesetzlich verboten. Falls die möglichen Gewinner nicht verständigt werden können, innerhalb der gesetzten Frist (falls zutreffend) nicht auf die Gewinnmitteilung antworten oder innerhalb der gesetzten Frist (falls zutreffend) die eidesstattliche Erklärung bzw. Bestätigung nicht unterzeichnen und zurücksenden, werden sie disqualifiziert und der Preis verwirkt. Wird ein möglicher Gewinner aus beliebigem Grund disqualifiziert, wird der Auftraggeber den Preis an einen anderen möglichen Gewinner vergeben, der nach den hier beschriebenen Kriterien ermittelt wird.

Nach der Bestätigung gemäß diesen Regeln wird der Gewinner mit der von den Schiedsrichtern vergebenen höchsten Punktezahl den ersten Preis, der Gewinner mit der zweithöchsten Punktezahl den zweiten Preis und der Gewinner mit der dritthöchsten Punktezahl den dritten Preis erhalten.

  1.  Preise:

  1. Gewährleistungen und Zusicherungen: Durch das Einsenden eines Videos gibt jeder Teilnehmer die folgenden Gewährleistungen und Zusicherungen ab:
    a. das Video ist das vom Teilnehmer aufgenommene Originalvideo;
    b. das Video verstößt gegen keine geistigen Eigentumsrechte, Persönlichkeitsrechte, öffentliche oder andere Rechte einer Drittpartei;
    c. das Video verletzt keine Gesetze, Bestimmungen oder diese offiziellen Gewinnspielregeln;
    d. das Video wurde nicht schon früher in einem anderen Wettbewerb oder Gewinnspiel eingereicht;
    e. das Video wurde bisher noch in keinem Medium veröffentlicht;
    f. der Teilnehmer hat diese offiziellen Gewinnspielregeln gelesen und verstanden;
    g. der Teilnehmer hat diese offiziellen Gewinnspielregeln jederzeit vollständig eingehalten und
    h. der Teilnehmer wird bis zur Beendigung des Gewinnspiels diese offiziellen Gewinnspielregeln weiterhin vollständig einhalten.

  1. Datenschutz und Veröffentlichung: Mit Ausnahme der hier genannten Fälle werden alle von den Teilnehmern im Zuge des Gewinnspiels übermittelten Daten nach der Datenschutzregelung des Auftraggebers behandelt (http://www.nexon.net/legal/privacy-policy/). Mit Ausnahme der Rechtsräume, in denen dies unzulässig ist, gibt der Teilnehmer mit seiner Teilnahme am Gewinnspiel seine Einwilligung zur Verwendung seines Namens, Abbilds, seiner Stimme, Meinungen, biografischen Daten sowie seines Wohnsitzes durch den Auftraggeber für verkaufsfördernde Zwecke in beliebigen Medien, ohne dass hierfür eine weitere Zahlung oder Vergütung fällig wird.

  2. Schadloshaltung: Mit der Teilnahme verpflichten sich die Gewinnspielteilnehmer zur Verteidigung, Entschädigung und anderweitigen Schadloshaltung des Auftraggebers und seiner Muttergesellschaft und verbundenen Unternehmen sowie der jeweiligen Bevollmächtigten, Funktionäre, Vorstände und Mitarbeiter (zusammenfassend die „entschädigten Parteien“) gegenüber sämtlicher Haftung jeder Art, die sich aus oder in Verbindung mit Folgendem ergibt:

a. technische Fehler, die die Teilnehmer an der Teilnahme hindern;
b. unbefugtes menschliches Eingreifen in das Gewinnspiel;
c. Fehler in der Durchführung des Gewinnspiels und
d. Körperverletzung, Tod oder Personen- und Sachschaden, welche direkt oder indirekt, ganz oder teilweise durch die Teilnahme des Teilnehmers am Gewinnspiel oder den Erhalt bzw. den Gebrauch eines Preises hervorgerufen werden, einschließlich dahingehender Forderungen vonseiten der Mitarbeiter der entschädigten Parteien oder Drittparteien.

Der Teilnehmer erklärt sich außerdem damit einverstanden, dass bei etwaigen Klagegründen die Haftung der entschädigten Parteien auf die Kosten der Teilnahme am Gewinnspiel beschränkt ist und die entschädigten Parteien keinesfalls für Anwaltshonorare haften. Der Teilnehmer verzichtet auf sein Recht auf Schadensersatzforderung, insbesondere direkten, indirekten Schadensersatz, Schadensersatz mit Strafwirkung oder Ersatz für Folgeschäden.

  1. Streitigkeiten: Mit Ausnahme der Rechtsräume, in denen dies unzulässig ist, erklären sich alle Teilnehmer damit einverstanden, dass sämtliche Streitigkeiten, Forderungen und Klagegründe, die sich aus oder in Verbindung mit dem Gewinnspiel oder einem übergebenen Preis ergeben, einzeln und ohne Anstrengung von Gemeinschaftsklagen und ausschließlich vor das zuständige Gericht in Los Angeles County, Kalifornien, USA zu bringen sind. Alle Angelegenheiten und Fragen zu Aufbau, Gültigkeit, Auslegung und Vollstreckbarkeit dieser Offiziellen Gewinnspielregeln, die Rechte und Pflichten des Teilnehmers oder des Auftraggebers im Zusammenhang mit dem Gewinnspiel unterliegen den Gesetzen des US-Bundesstaates Kalifornien und sind danach auszulegen; Rechtswahl oder Regeln zum Kollisionsrecht (des US-Bundesstaats Kalifornien oder eines anderen Rechtsraums), die die Anwendung der Gesetze eines anderen Rechtsraums als des US-Bundesstaats Kalifornien auslösen würden, sind ausgeschlossen.

  2. Allgemeine Bedingungen: Falls die Durchführung, Sicherheit oder Verwaltung des Gewinnspiels aus irgendeinem Grund auf irgendeine Weise gestört ist, insbesondere durch Betrug, Viren oder andere technische Probleme, kann der Auftraggeber in seinem alleinigen Ermessen entweder (a) das Gewinnspiel aussetzen, um die Störung zu beheben, und das Gewinnspiel danach im bestmöglichen Sinne dieser offiziellen Gewinnspielregeln wieder aufnehmen, oder (b) die Preise unter den bis zum Zeitpunkt der Störung eingegangenen Einsendungen verlosen. Versuche, den rechtmäßigen Ablauf des Gewinnspiels zu unterwandern, stellen möglicherweise Verstöße gegen das Straf- und Zivilrecht dar und der Auftraggeber behält sich im Falle derartiger Versuche das Recht vor, von der betreffenden Person insoweit rechtlich zulässig Schadensersatz zu verlangen. Die Unterlassung aufseiten des Auftraggebers, eine Bestimmung dieser offiziellen Gewinnspielregeln durchzusetzen, stellt keinen Verzicht auf die betreffende Bestimmung dar. Das Gewinnspiel ist dort ungültig, wo es nicht zugelassen ist.

  3. Liste der Gewinner: Die Gewinner werden vom Auftraggeber spätestens dreißig (30) Tage nach Bestätigung des Gewinners auf der Thread-Seite bekannt gegeben.

Aucun achat n’est requis pour participer ou gagner

  1.   Commanditaire : Le concours Dirty Bomb « Epic Kills III 2016 » (la « Promotion ») est commandité par Nexon America Inc., 222 N. Sepulveda Blvd., Suite 200, El Segundo, CA 90245, États-Unis d'Amérique (le « Commanditaire »).

  2.   Conditions de participation : La Promotion est réservée aux joueurs actuels de Dirty Bomb qui : (a) sont âgés d'au moins treize (13) ans au début de la période de Promotion (définie ci-dessous) ; sont des résidents des États-Unis, du Canada (à l'exclusion du Québec), du Royaume-Uni, de l'Allemagne ou de la France ; et (c) n'ont jamais été exclus ou suspendus, ou n'ont jamais fait l'objet d'une exclusion ou d'une suspension de compte pour des raisons de piratage informatique ou pour des contraventions similaires aux accords de licence de Dirty Bomb et/ou aux conditions générales du Commanditaire. Tout participant n'ayant pas atteint l'âge de la majorité dans sa juridiction de résidence doit obtenir de la part de son parent ou tuteur la permission de participer à la Promotion et devra apporter la preuve de cette permission au Commanditaire sous la forme requise par celui-ci. Les employés, les dirigeants et les administrateurs de Nexon America Inc., leurs sociétés affiliées, leurs agents, les membres de leur proche famille (c'est-à-dire les parents, enfants, frères et sœurs et mari ou femme), ainsi que les personnes chez qui ils sont domiciliés, ne sont pas autorisés à participer.La Promotion est nulle et sans effet lorsqu'une loi l'interdit.

  3.   Acceptation du règlement officiel : La participation à la Promotion vaut accord plein et inconditionnel de la part du participant et acceptation du présent Règlement officiel et des décisions du commanditaire qui sont finales et contraignantes.La remise d'un prix est subordonnée au respect de toutes les conditions définies dans les présentes.

  4.                           Dates : La Promotion commence au moment de l'annonce faite par le fil de discussion du Commanditaire (le « Fil ») et se termine le 3 novembre 2016 à 23h59 minutes, 59 secondes, heure du fuseau horaire du Pacifique aux États-Unis d'Amérique (la « Période de Promotion »). Les soumissions reçues avant le début de la Période de Promotion ou après sa conclusion seront disqualifiées. L'ordinateur du commanditaire fera office de chronomètre officiel de cette Promotion.Il incombera aux participants de déterminer les différences de temps entre fuseaux horaires.

  5.   Comment participer : Pour être admis dans la Promotion, les participants devront réaliser une vidéo montrant leurs « epic kills » dans le jeu Dirty Bomb.Une fois réalisée, la vidéo doit être téléchargée sur YouTube et un lien vers l'emplacement de cette vidéo sur YouTube doit être publié sur le Fil, accompagné du « nom de jeu » du participant.

  6.   Conditions d'admission des soumissions : Toutes les vidéos soumises au Commanditaire dans le cadre de cette Promotion doivent répondre aux directives suivantes quant à la technique utilisée et au contenu de la vidéo.Toute vidéo qui contrevient à ces règles ne pourra être jugée ou recevoir un prix :

Directives techniques.La vidéo doit :
a. Être d’un format susceptible d’être accepté par YouTube ;
b. Avoir été téléchargée sur YouTube ;
c. Être d’une durée comprise entre une (1) et sept (7) minutes, et
d. Être accessible au public.

Directives relatives au contenu.La vidéo doit :
a. Provenir du jeu du participant sur Dirty Bomb ;
b. Contenir des séquences et des images créées au plus tôt le 10 octobre 2016 ; L’inclusion de séquences ou d’images réalisées ou filmées avant le 10 octobre peut entraîner la disqualification de la vidéo ;
c. La vidéo ne doit pas contenir de matériel violant ou contrevenant aux droits d’autrui, y compris notamment les droits à la vie privée, droits de publicité ou de propriété intellectuelle ou protégeant contre la contrefaçon de marque ;
d. Elle ne doit dénigrer en aucune façon le Commanditaire, aucun de ses produits ou services, ou toute personne ou partie affiliée à la présente Promotion ; elle ne doit pas en outre promouvoir un concurrent direct du Commanditaire ;
e. Elle ne doit pas contenir d’images ou illustrations inappropriées, indécentes, obscènes, de propos haineux ou offensants, calomnieux, médisants ou diffamatoires (aux yeux du Commanditaire et à sa seule discrétion) ;
f. Elle ne doit pas contenir de menaces (expresses ou implicites) envers toute personne, toute entreprise ou tout groupe ;
g. Elle ne doit pas violer les droits à la vie privée de toute personne, toute entreprise, ou tout groupe ;
h. Elle ne doit pas citer ni représenter une personne tierce existante sans sa permission ;
i. Elle ne doit contenir aucun texte ni aucune illustration incitant au fanatisme, au racisme, à la haine ou encourageant le dommage physique porté à un groupe ou un individu, ni prôner la discrimination sur la base de la race, du sexe, de la religion, de la nationalité, d’un handicap ,d’une orientation sexuelle ou de l’âge ; et
j. La vidéo ne doit pas contenir de matériel illégal, en violation ou en contravention avec les lois ou réglementations de toute juridiction où la vidéo est réalisée.

La limite est fixée à une (1) vidéo par personne ou par compte Steam. Le Commanditaire n’est pas responsable de toute vidéo perdue, parvenue en retard, incomplète, invalide ou parvenue à la mauvaise adresse, qui serait disqualifiée ou non prise en compte (le cas échéant) ou de toute erreur, qu’elle soit d’origine humaine, technique ou autre. Le Commanditaire se réserve le droit, à sa seule discrétion, de disqualifier tout participant qui, selon son jugement, a altéré le déroulement de la Promotion, par exemple en effectuant une soumission automatique ou en utilisant des logiciels de génération automatique de texte, ou a enfreint le présent Règlement officiel. Dans le cas d’un litige survenant quant à l’identité d’un Participant, le détenteur autorisé de l’identificateur du compte Nexon.net utilisé pour l’enregistrement au Forum sera déclaré le Participant. Le « détenteur autorisé du compte » est la personne qui s’est vue attribuer une adresse e-mail par un fournisseur d’accès Internet, un fournisseur d’accès en ligne ou toute autre organisation responsable de l’assignation d’adresses e-mail pour le domaine associé avec l’adresse e-mail enregistrée pour l’identité Steam.

  1.   Propriété intellectuelle :En soumettant une vidéo dans le cadre de la présente Promotion, chaque Participant reconnaît et convient de ce qui suit :

a. Le Participant accorde irrévocablement au Commanditaire, ses agents, licenciés et assignés les permissions et droits inconditionnels et perpétuels (non exclusifs) de protéger les droits d’auteur en son propre nom, de reproduire, coder, copier, transmettre, publier, diffuser, exposer, faire jouer ou lire publiquement, adapter, modifier, créer des œuvres dérivées, exposer et utiliser la vidéo et son contenu, ou toute partie de la susdite, telle qu’elle ou modifiée (en mentionnant ou non le nom de son auteur) par, ou sur tout support au monde, pour quelque motif que ce soit, sans limite et sans examen, compensation quelconque ou approbation de tout Participant ou d’une partie tierce.
b. Le Participant renonce expressément et définitivement à tout droit de propriété intellectuelle, droit de marque, droit de vie privée ou autre droit d’ordre moral ou légal pouvant restreindre l’utilisation de la vidéo par le Commanditaire, ou nécessiter pour le Commanditaire d’obtenir une permission pour utiliser la vidéo.
c. Le Participant accepte de ne pas instiguer, soutenir, mener ou autoriser une action, réclamation ou action en justice contre le Commanditaire pour le motif que l’utilisation de la vidéo ou d’œuvres dérivées de cette vidéo contrevient à tout droit que tout Participant ou tierce partie pourrait détenir en tant qu’auteur (ou co-créateur), notamment les droits d’auteur, droits de marque ou obligations d’ordre moral.
d. Le Participant accorde irrévocablement au Commanditaire, ses agents et licenciés, et leur assigne les droits et permissions (non exclusifs) sans conditions, sans redevance, à perpétuité et pour le monde entier d’utiliser le nom, l’image, la voix et autres représentations du Participant, inclus dans la vidéo et remis au Commanditaire dans le cadre de sa participation à la Promotion, sur tout support connu de nos jours ou inventé à l’avenir, pour toute utilisation commerciale, y compris notamment une utilisation publicitaire ou de promotion des produits et services du Commanditaire, sans aucune compensation ni le droit d’approuver de telles utilisations.

  1.   Sélection du gagnant :Au terme de la période de la Promotion, le Commanditaire choisira un juge qualifié ou un comité de juges pour juger toutes les vidéos éligibles selon les critères suivants :

a. Créativité exprimée lors des « kills » – 25 %
b. Qualité de la vidéo – 25 %
c. Aptitude au jeu Dirty Bomb/expertise montrées dans la vidéo – 50 %

Le ou les juges sélectionneront trois (3) gagnants potentiels parmi tous les Participants éligibles en utilisant les critères notés ci-dessus. Les gagnants potentiels seront informés après la date de sélection à l’adresse e-mail associée à leurs noms dans le jeu (ou par tout autre moyen de communication retenu par le Commanditaire). Il pourra être demandé aux gagnants potentiels du prix de communiquer des renseignements personnels supplémentaires afin de confirmer leur admissibilité et de leur décerner le prix. Il pourra également leur être demandé de signer un Affidavit d’admissibilité ou une Déclaration de conformité (selon les cas, en fonction du lieu de résidence du gagnant potentiel), à moins que la loi ne l’interdise. Si un gagnant potentiel ne peut pas être contacté, ne répond pas à la notification dans les délais prescrits (le cas échéant) ou ne signe pas et ne retourne pas l’Affidavit ou la Déclaration dans les délais prescrits (le cas échéant), il sera disqualifié et perdra ses droits au prix. Si un gagnant potentiel est disqualifié pour une raison quelconque, le Commanditaire décernera le prix à un autre gagnant potentiel, à choisir selon les critères de sélection des gagnants indiqués dans la présente Section.

Une fois confirmé aux termes des règles énoncées ci-dessus, le gagnant ayant obtenu le plus de votes de la part du ou des juges recevra le premier prix, le gagnant ayant obtenu le deuxième nombre de votes recevra le prix de la deuxième place, et le gagnant ayant obtenu le troisième nombre de votes recevra le prix de la troisième place.

Pour tous les prix : Tous les aspects des prix non décrits ici (taille, style, couleur, etc.) seront déterminés par le Commanditaire et à sa seule discrétion. Aucun paiement en numéraire ni autre substitution ne sont permis, sauf pour le Commanditaire qui pourra remplacer un prix (ou un de ses composants) avec un autre prix (ou composant) d’une valeur égale ou supérieure, comme déterminé par le Commanditaire et à sa seule discrétion. Un prix (ou un de ses composants) n’est pas transférable ou remboursable et il doit être accepté tel qu’il a été décerné. Les gagnants paieront tous les autres frais et toutes les dépenses non mentionnés ci-dessus. Les gagnants seront responsables du paiement de toutes les taxes applicables en relation avec l’acceptation et l’utilisation d’un prix.   1. Garanties et déclarations :En soumettant une vidéo, chaque Participant déclare et garantit que :
    a. la vidéo est une œuvre originale du Participant ;
    b. la vidéo ne porte pas atteinte aux droits de propriété intellectuelle, de vie privée, aux droits publicitaires ou à tout autre droit de tout tiers ;
    c. la vidéo ne viole aucune loi, aucune réglementation, ni aucune des dispositions du présent Règlement officiel ;
    d. la vidéo n’a pas auparavant été présentée dans un autre concours ou une autre promotion ;
    e. la vidéo n’a jamais été publiée sous n’importe quelle forme ;
    f. le Participant a lu et compris le Règlement officiel ;
    g. à toutes les étapes de sa participation, le Participant s’est pleinement conformé à ce Règlement officiel ; et
    h. le Participant continuera à se conformer pleinement à ce Règlement officiel, jusqu’à la conclusion de cette Promotion.

  1. Protection de la vie privée et publicité : Sauf indication contraire mentionnée aux présentes, toutes les informations fournies par les participants à la Promotion seront traitées conformément à la politique de confidentialité du Commanditaire (http://www.nexon.net/legal/privacy-policy/).Sauf lorsque la loi l’interdit, la participation à la Promotion vaut consentement du participant à l’utilisation de son nom, de son image, de sa voix, de ses opinions, de ses informations biographiques et de son pays et État ou province de résidence à des fins promotionnelles dans tous les médias sans autre forme de rémunération ou de contrepartie.

  2. Indemnisation :En participant à cette Promotion, les Participants acceptent de défendre, indemniser et autrement protéger le Commanditaire, ses sociétés mères, filiales, ses agents, dirigeants, cadres et employés (collectivement, les « Parties exonérées ») contre toute responsabilité de quelque nature qu’elle soit, découlant ou résultant de :

a. toute erreur technique pouvant empêcher les participants de participer à la Promotion d’une quelconque façon que ce soit ;
b. de toute intervention humaine non autorisée dans la Promotion ;
c. de toute erreur dans l’administration de la Promotion ; et
d. de toute blessure, décès ou dommage de toute nature à la propriété, découlant, directement ou indirectement, en totalité ou en partie, de la participation du Participant à la Promotion ou de sa réception ou utilisation de tout prix, y compris de toute plainte de cet ordre par les Parties exonérées ou toute autre tierce partie.

Le Participant accepte par ailleurs qu’en cas de recours, la responsabilité des Parties exonérées se limitera au coût de la participation à ladite Promotion, et qu’en aucun cas les Parties exonérées ne seront responsables des frais d’avocats. Le Participant renonce par ailleurs à toute réclamation quelle qu’elle soit y compris notamment, les dommages punitifs, corrélatifs, directs ou indirects.

  1. Litiges : Sauf lorsque la Loi l’interdit, tous les participants acceptent que tous les litiges, réclamations et recours découlant de la Promotion ou de tout prix décerné, ou s’y rapportant, soient résolus individuellement, sans avoir recours à une forme quelconque de recours collectif, et portés exclusivement devant le tribunal compétent du comté de Los Angeles, État de Californie, États-Unis d’Amérique. Tous les points et questions relatifs à l’établissement, la validité, l’interprétation et l’applicabilité du présent Règlement officiel, aux droits et obligations du Participant ou aux droits et obligations du Commanditaire dans le cadre de la Promotion, seront régis et interprétés conformément aux lois de l’État de Californie, États-Unis d’Amérique, sans égard au choix de la loi ou des règles de conflit de lois (qu’elles soient celles de la Californie ou de toute autre juridiction), susceptibles d’entraîner l’application des lois de toute juridiction autre que celle de la Californie.

  2. Conditions générales : Dans le cas où le déroulement, la sécurité ou l’administration de la Promotion serait altéré d’une façon quelconque pour une raison quelconque, notamment pour fraude, virus ou autre problème technique, le Commanditaire pourra, à sa seule discrétion, soit (a) suspendre la Promotion pour remédier au problème, puis la reprendre de la manière la plus conforme à l’esprit du présent Règlement officiel ; soit (b) décerner le prix en choisissant parmi les soumissions reçues jusqu’au moment où le problème est survenu. Toute tentative délibérée par quiconque ayant pour but de nuire au déroulement légitime de la Promotion peut constituer une infraction aux lois pénales et civiles et, si une telle tentative est commise, le Commanditaire se réserve le droit de réclamer des dommages-intérêts à la personne responsable dans toute la mesure permise par la loi. La non application par le Commanditaire d’une quelconque disposition du présent Règlement officiel ne constitue pas une renonciation à cette disposition.La Promotion est nulle et sans effet lorsqu’une loi l’interdit.

  3. Liste des Gagnants : Les Gagnants seront annoncés par le Commanditaire sur la page du Fil de discussion dans un délai de trente (30) jours après la confirmation de tous les Gagnants.
