At what point do we have the right to return a game for full refund?

After watching the disaster that is the Brink launch it go me to thinking - What are our rights to demanding our money back on a game that is released ‘broken’?

If I go to watch a film in the cinema and that film was out of focus, stuttered about and and just stopped and you had to start from the beginning again I know I would expect a full refund and apology. Why can’t we expect the same from a game, they are both classed as the entertainment industry after all?

I know people say wait for a patch (but to be honest why should we) but there is no guarantee that the game will be patched to a acceptable level so what are our rights as a consumer?

Brink could be such a good game if the bugs were ironed out but as it stands there are just too many. Is there a governing body that over looks this sort of thing, if not why not?

I suppose this example could be used for many games that are released but as this is Splash Damage’s forum I am asking this in relation to the game Brink.
