I do remember that only one part of a song can be the same. Forgot which though.
Song title?
Artist?
Album?
Don’t remember it.

Probably title, because that’s what I’m talking about.
You can have songs with the same title, although you have to say a cover is a cover (otherwise it can be brought to court).
Two of the same artists is definitely a problem, seeing as Rhapsody switched their name to Rhapsody of Fire.
Album falls under the “can be brought to court category” afaik.
Books can have the same titles, ie you could make The Lord of the Rings, but it would have to bear no resemblance. Also, if you had two the Lord of the Rings books that got popular, the first one to set up a merchandise chain, etc, would be the only one that can use that name under that specific division.
Any two sides fighting for a copyright can either make a settlement (this includes one side buying the copyright or the agreement that both can use the name) or go to court with the issue. This can be seen in Avatar vs The Last Airbender, for instance, where (I don’t care to research it, post it if you know it) the maker of the movie Avatar (the Titanic guy) bought the rights for a sum of money (in the millions) if I remember right.
Also, I am tired, so all of this may be wrong.
