Bitte um Prüfung der Untersagung der Veröffentlichung der Map "Castle Eltz"

Sehr geehrte Damen und Herren,

mein Name ist xxxxxx und ich spiele seit Veröffentlichung das kostenlos im Internet erhältliche Spiel "Wolfenstein: Enemy Territory" ("W:ET").

Vor kurzem wurde eine ebenfalls kostenlos erhältliche Spielwelt ("Map") mit Namen "Castle Eltz" veröffentlicht.
Mit Bedauern habe ich gelesen, das Sie eine Veröffentlichung von Bildern der Map und auch die Veröffentlichung der Map untersagt haben. 

Die Map ist technisch, künstlerisch und spielerisch sehr gelungen und professionell gestaltet.
Der Autor war sicherlich von der Schönheit und Einzigartigkeit der Burg Eltz inspiriert.
Eine der besten Maps für das Spiel.

Da weder das Spiel noch die Map zum Verkauf angeboten werden, gibt es keinen kommerziellen Hintergrund.

Das Spiel "W:ET" wird täglich weltweit von mehreren tausend Spielern gespielt.
Die Map stellt somit eine zusätzliche, kostenlose, weltweite Werbung für die Burg dar.
Eventuell könnte man in einer mitveröffentlichten Datei/auf der Webseite des Autors auf die echte Burg Eltz und die Webseite der Burg hinweisen.
Eventuell gibt es ja auch die Möglichkeit, die Map mit anderem Namen und dem Hinweis in einer mitveröffentlichten Datei/auf der Webseite des Autors "inspiriert von Burg Eltz" zu veröffentlichen.

Über eine Antwort von Ihnen freue ich mich.

Pick another castle and let’s be done with it. Maybe send it to show you took the time of changing the map around.

They have copyright of those things in Germany, but you are using them in the Netherlands. Unless they have copyright there, they can not do anything about it. Add a line to your readme.txt “This map can only be used outside of Germany due to possible copyright issues.” You are not breaking any Dutch Laws, unless you have copied images or whatever of their website. Then they might make a civil law suite against you. “Strafrechtelijk” (no clue about the English word for it) they are on thin ice. If they really wanted to go trough with it, they need to send NL “Rechtshulverzoek”, a Dutch region or someone at, lets say, my national office :slight_smile: has to take that request and have to act on it. Those changes are almost zero.

That would be very hard to control, as no one can command to remove the map if it’s played on a German server, except those guys from Eltz.

  • I’d be fed up with this whole situation and leave it as it is
    (maybe use brushwork - edit it and import in a new scenario)

It’s barely possible they would succeed in taking legal actions… you can possibly tell them you talked the problem over with your lawyers (+ mention that you are not making any profits etc. etc.). LOL, too funny to be real :slight_smile:

You should never lie about that! Legal cases are a serious thing and telling lies will make it all to sweet for them. Don’t forget that most of us in this forum live in the EU and EU has it’s own Copyright Law, protecting the property of different EU nations across the union.

So don’t irritate them, once you cross the line there is no coming back; everyone has the right to turn to European Court of Justice and as far as I know it does not matter from what part of the EU you are from.

In the army, we called people like this $hit-house lawyers. You know the type. They are the guys who are crapping in the stall next to you while they dispense their professional advice and opinions on all kinds of subjects whether it was asked for or not.

In this case, the term applies even more since they really are acting like lawyers.

Despite everyone’s good intentions, it doesn’t matter if they have the rights to it or not, or if their claims are BS or not. They own a damn castle so they have plenty of money to throw away if they want to take him to court. He just needs to redesign his castle so that it is no longer recognizable as the real Castle Eltz. Maybe something like this. :slight_smile:

Well, it’s good to know you will be offering your services Pro Bono to Firefly if he does get sued. I’m sure their lawyers will go easy on you since you are still a student.

Law is a really big field, that’s why most lawyers pick one aspect of it to make their money in and forget the rest. I don’t think I’d want a Bankruptsy lawyer defending me in court next time I get caught molesting myself in public. But I guess being a student means that all those laws are still fresh in your head. So your advice as a “legally educated” $hit-house lawyer must be more valid than those of us who are simply “home schooled” $hit-house lawyers.

Even a Real lawyer can be a $hit-house lawyer. They are just better at convincing the Jury their that their client’s Turds are innocent.
